Анотація

Стаття присвячена комплексному дослідженню історико-правового огляду становлення і розвитку Національної гвардії України як суб’єкта протидії загрозам національній безпеці України. Сформульовано авторське бачення положень щодо генезису становлення Національної гвардії України як військового формування з правоохоронними функціями. За результатами дослідження надано визначення: “Національна гвардія України, будучи учасником правовідносин у сфері протидії загрозам національній безпеці України, здійснює діяльність врегульовану нормами військово-адміністративного права, що ґрунтується та змінюється у залежності від адміністративно-правових режимів; має визначені законом повноваження щодо виявлення, відвернення, знищення та зменшення негативного впливу з боку агресора”. Запропоновано класифікацію історико-правових етапів діяльності НГУ : а) створення та розбудова організаційної структури НГУ в період часу з 1991 р. по 2000 р.; б) час реформування, що протікає у два періоди: з 2001 р. по 2013 р. (час функціонування Внутрішніх військ МВС України) та з 2014 р. по теперішній час (час формування та оновлення НГУ у відповідності до світових стандартів). Акцентовано увагу на проблемних питаннях, які виникають на сучасному етапі розвитку держави
