Regulatory and legal provision of social support for elderly people

Abstract

The article discloses the legal framework of social support for the elderly. The macro-level and micro-level of social work with the elderly are distinguished. After the full-scale invasion of Russia, the Ministry of Social Policy as early as March 2022 developed recommendations for the organization of the provision of social services under martial law.

It is worth drawing attention to the fact that today in Ukraine a system of legislation has been created, focused on the regulatory and legal support of the elderly and aimed at their social support. Attention is focused on the Constitution of Ukraine, which lays down state guarantees regarding the observance of the basic rights and freedoms of a person, including the elderly. On the basis of international legal acts, a system of regulating the provision of social assistance to the elderly was developed in Ukraine, including a number of laws. At the community level, it is necessary to note the Orders of the Ministry of Social Policy of Ukraine, which allow determining the needs of the elderly in social services.

It has been proven that social support includes social and psychological services, which are regulated by more specialized acts based on the norms of the Laws of Ukraine "On Psychiatric Assistance" and "On Social Services".

In the context of providing social support to the elderly, separate state standards of social services are given, among them: social adaptation, social counseling services, inpatient care for persons who have lost the ability to care or have not acquired such ability, palliative care. Thus, regulatory and legal regulation in Ukraine is aimed at creating a regulatory and legal field and developing rules for social protection and support of the elderly. It includes the creation of normative legal acts at various levels.
