Abstract

The article examines the history of intellectual property. Detected some approaches to the interpretation of the concept of «intellectual property» in terms of different scientists. On the basis of the Convention establishing the World Intellectual Property Organization transferred rights includes intellectual property. According to the current legislation of Ukraine stipulates who is the subject of intellectual property, namely: citizens, legal persons and the state. Classification of intellectual property, which consists of industrial property (inventions, industrial designs, utility models, industrial designs, trademarks for goods and services, appellations of origin, trade names) of copyright (works of science , literature and art that result from creative activity) and related rights (rights of performers, phonogram producers and broadcasting organizations) and non-traditional intellectual property (plant varieties, topographies of integrated circuits, trade secrets (know-how). And also in addition held characterization of each group of intellectual property that are in the classification. These and described that one of the features of IP is that it contains a moral intellectual property rights and (or) intellectual property rights. Shows modern Ukraine legislative framework in the field of intellectual property are, which consists of the Constitution of Ukraine, Ukraine Code, special laws of Ukraine, decrees and orders of the President, the Cabinet of Ministers of Ukraine, departmental regulations and so on. Transferred benefits from the use and creation of intellectual property.
