Abstract

The article shows consistent pattern of the tendencies and specific incidents concerning violation of the copyright and inappropriate usage of the materials protected by the legislation. Occurrences of the violation of exclusive rights that are provided to a copyright or a related right subject had been reviewed in this article. Particular kinds of the preventive methods aimed to reduction of frequency of copyright and related right violations were distinguished in this work. In accordance with the results of the conducted research within a framework of a discussed subject, appropriate conclusions concerning the methods of protection of the copyright and related right subjects in the Internet in terms of Ukrainian Legislation were made in this article. Amongst the others kinds of protection, the following preventative methods were singled out and examined: civil and criminal legislation, various international agreements and pacts, protection of the digital version of mass media sources from invasion of the law-breakers and unauthorized copying, and also the importance of usage of the DRM-systems in the process of control of the piracy in the Internet.On the ground of the research results, possible ways of improvement of the electronic tools for protection of the copyright and related right objects in the Internet were proposed in this article. Weak features of existing technical methods of protection were pointed out. Alternative ways of solution of this problem were reviewed by analogy with already existing foreign preventative methods.The most ambitious method from the point of view of effectiveness aimed for protection of the copyright and related right objects was identified. Arguments in organizational method’s favor were presented in this article. Necessity of development of the juridical level of social environment were pointed out. The essence of the organizational method that lays in popularization of respectful attitude towards copyright and related right objects in the Internet was defined in this work.
